Abbaji Interiors (“Abbaji Interiors”, “we”, or “us”) is the sole and absolute owner of the brand name “Abbaji Interiors” and domain www.abbajiinteriors.com and any other subsequent web/mobile application (the “Site”). Abbaji Interiors respects your privacy and the same is maintained as per the Privacy Policy. As a visitor to the Site and user of the services at the Site, you are advised to please read these Terms and Conditions (Terms) carefully and access the Site. For the avoidance of doubt, please note that references to the Site in these Terms include any current or future version of the Site. By accessing the Site, you agree to these Terms. If you do not agree to these Terms (without modification), you are advised to not access or use the Site. Please note that any reference to Abbaji Interiors at the Site shall mean to refer and include its affiliates, group companies, agents, officers, and employees.

Also when you place an order as a guest or by registering on the website, you are accepting the terms of service. In so doing, you consent to receive communications from us electronically. All trademarks, service marks, and trade names of Abbaji Interiors used in the Site (including but not limited to the name Abbaji Interiors) are proprietary to Abbaji Interiors, registered under the laws of India. They may not be used without Abbaji Interiors’s prior written permission. Any other intellectual property on the Site, including but not limited to images, designs, patents, issued or pending, are the sole property of Abbaji Interiors and/or its licensors.
4. COPYRIGHT
Images of people, places, and/or products posted on this Site are either the property of Abbaji Interiors or our licensors. Unless otherwise noted, all content included on this Site, including images, illustrations, designs, icons, photographs, video clips, and written and other materials (together, with “Marks” (as defined below), “Abbaji Interiors”) is the property of Abbaji Interiors or its licensors, partners or affiliates and is protected by Indian and international copyright laws. The compilation of this Site is the exclusive property of Abbaji Interiors and is protected by Indian and international intellectual property laws. Any unauthorized use of any content or materials on this Site is strictly prohibited and may violate copyright and trademark laws, and/or the laws of privacy, publicity, and/or communications regulations and statutes. You may use the materials or content on this Site only with our prior written and express authorization. 5. ORDERING PROCESS
The Site displays a list of varied merchandise and offers for sale, including but not limited to Furniture and Home Decor (Products). All purchases made on the Site are subject to Abbaji Interiors’s acceptance, which is at its sole discretion. Without limitation, this means that Abbaji Interiors may refuse to accept or cancel any order, whether or not the order has been confirmed, for any or no reason, in its sole discretion, and without liability to you or any third party. Without limiting the foregoing, Abbaji Interiors reserves the right to refuse to accept or cancel any orders that are to be shipped to any freight forwarding or similar service, whether or not the order has been confirmed. If your credit/debit card has already been charged for a purchase that is subsequently canceled, the Site shall issue a credit to your credit/debit card account.
In case a Product appears out of stock, feel free to write to Abbaji Interiors at any of the contact information provided herein to get notified about the re-stocking of the said Product.
6. PRICING
The price listed on the Site for the Product will be inclusive of taxes and you will be required to make payment of the final invoiced amount of such price including delivery/handling charges or other additional sums that form part of the final invoice. Abbaji Interiors makes every attempt to properly price all Products, but errors may occasionally occur. These pricing errors may result in a lower or higher stated price on the Site. Abbaji Interiors reserves the right to cancel orders that include a pricing or discount error.
7. PROHIBITED USE
The contents of this Site can be used solely for your non-commercial purposes, or to place an order with the Site, or to purchase any other products on the Site. Any other use, including but not limited to the reproduction, distribution, display, or transmission of the content of the Site is strictly prohibited unless authorized by Abbaji Interiors. You further agree not to do any of the following: (a) resell or make any commercial use of this Site or any of the contents of this Site; (b) modify, adapt, translate, reverse engineer, decompile, disassemble or convert into human-readable form any of the contents of this Site not intended to be so read. 8. DISCLAIMER OF WARRANTY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: THE SITE, SERVICES, AND THE PRODUCTS THEREIN ARE PROVIDED BY THIS SITE IS ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT (I) YOUR REQUIREMENTS WILL BE MET OR THAT SERVICES PROVIDED WILL BE UNINTERRUPTED, OR PROMPTLY; (II) ANY ERRORS OR DEFECTS IN THE SITE, SERVICES OR OTHER PRODUCTS WILL BE CORRECTED; (III) THE PRODUCTS OFFERED THROUGH THE SITE SHALL BE AS PER THE IMAGES PROVIDED ON THE SITE, SHALL MATCH THE DESCRIPTION ON THE SITE OR BE FIT FOR CONSUMPTION. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL HAVE NO LIABILITY RELATED TO USER CONTENT ARISING UNDER INTELLECTUAL PROPERTY RIGHTS, LIBEL, PRIVACY, PUBLICITY, OBSCENITY, OR OTHER LAWS. WE DISCLAIM ALL LIABILITY FOR THE MISUSE, LOSS, MODIFICATION, OR UNAVAILABILITY OF ANY CONTENT OR PRODUCTS ON THE SITE. DIRECT DAMAGES AND LOSSES SHALL ONLY BE RECOVERABLE UNDER THESE TERMS. IN NO EVENT SHALL ABBAJI INTERIORS, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE TO YOU, OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING THOSE RESULTING FROM BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR ACCESS TO THE SITE, SERVICES OR PRODUCTS.
THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
9. INDEMNITY
You agree to indemnify, defend, and hold harmless Abbaji Interiors, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your registered account (including negligent or wrongful conduct) by you or any other person accessing the Site using your registered account with us.
10. SUSPENSION OF YOUR ACCOUNT OR SITE
You agree that we may temporarily suspend access to the Site to diagnose any technical issues and resolve the same, improve the quality and functionality of the Site, or implement any changes to the Site. We may suspend your access to the Site, where it is necessary to safeguard the security and integrity of the network; or implement emergency planning measures due to any technical failure of the network; or where required by applicable law or directed by any governmental authority. You acknowledge that during such time the Site may not run at capacity; or may be unavailable in a particular network area; and/or coverage could be affected or the network may be suspended for any technical failure of the network.
In case of any suspicious activity observed by you regarding your account with the Site or it appears to you that your credentials have been compromised, you are required to notify Pelican about the same at the earliest by contacting us and Abbaji Interiors shall assist in the recovery of your account and in resetting your password and necessary information.
11. LINKS TO THIRD-PARTY WEBSITES
Abbaji Interiors neither endorses nor promotes or provides any service via social media through necessary integration. For this purpose, you may opt to log in to social media by creating an account or signing in on such social media. You agree to access the third-party links and advertisements on the Site at your sole discretion and in compliance with the terms and conditions of such website or application and Pelican shall not be responsible for any kind of transmission or publication of any content on any social media. Third-party links on this Site may direct you to third-party websites that are not affiliated with Abbaji Interiors. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or any other materials, products, or services of third parties. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.
12. RETURNS/ REFUND/CANCELLATION
Cancellation: You may request cancellation of the order placed for a Product at any time before shipment. If you do not wish to receive the order delivered, you may email Abbaji Interiors at abbajiinteriors@gmail.com and cancel your order. We will initiate your refund after we have confirmation of the order canceled by you.
Return: You may return the Product in an unused condition with the packaging intact not later than ten (10) days from the date of delivery of the order.
If the product is returned after ten (10) days, which is Abbaji Interiors' standard return period, or the item is damaged, or not in its original packaging, Abbaji Interiors will be unable to honor a refund for the merchandise and the decision of Abbaji Interiors shall be final. No return or any other claim will be acceptable or valid after the expiration of 10 days from the time of delivery of the Product.
Please note that the Products from outside of India are not eligible for return.
The Product can be returned by simply writing an email to abbajiinteriors@gmail.com.
Your payment will be processed within seven (7) business days of receipt of the returned package.
13. FEEDBACK AND QUERIES
In case a Product appears out of stock, feel free to write to Abbaji Interiors at any of the contact information provided herein to get notified about the re-stocking of the said Product.
Where you post any review, submission, feedback, or comment or any statement of such nature on the related link, such content shall be posted publicly on the Site at the sole discretion of Abbaji Interiors and shall not be subject to any alteration or modification or moderation by Abbaji Interiors or its members. You agree that Abbaji Interiors is free to use any comments, information, or ideas contained in any communication you may send to the Site or submit to the Site without notice, compensation, or acknowledgment to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Site or other products or services.
Abbaji Interiors does not and cannot review all communications and materials posted to or created by you who are using or accessing the Site and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute (for non-commercial purposes) the contents of the Site, the Site is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any user-related content or activities on the Site. You may not post or otherwise distribute content to the Site which Abbaji Interiors in its sole discretion determines to be abusive, harassing, threatening, defamatory, obscene, an impersonation of others, fraudulent, deceptive, misleading, in violation of a copyright, trademark, or other intellectual property rights of another, invasive of privacy or publicity rights, in violation of any other right of Abbaji Interiors or another party, illegal, or otherwise objectionable to Abbaji Interiors. You may not upload commercial content on the Site or use the Site to solicit others to join or become members of any other commercial online service or other organization.
14. FORCE MAJEURE
You agree that Abbaji Interiors shall not be responsible for any failure or delays to fulfill any obligation under these Terms, for so long as, and to the extent to which, the fulfillment of such obligation is impeded by a force majeure event, which shall mean to include, but not limited to, an event which is beyond the control of Abbaji Interiors; Act of God; traffic; unavailability of Product. However, all reasonable efforts and precautions shall be undertaken by Abbaji Interiors to supervene and subside any such event and perform the obligations as per the Terms.
15. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by, and construed by the laws of India. You irrevocably submit to the exclusive jurisdiction of the courts of Mumbai, Maharashtra. This does not prevent Abbaji Interiors from making an application to any court of competent jurisdiction to obtain an interim remedy (including any injunction) at law or in equity about any dispute that arises about these Terms.
16. COMPLAINTS AND RESOLUTION MECHANISM
Abbaji Interiors shall endeavor to resolve any complaint and dispute, that may arise on account of your online purchase of the Product, technical difficulty, or for the services received. Complaints about the Products shall be forwarded to Abbaji Interiors at the email address abbajiinteriors@gmail.com for further review, investigation, and response. You must follow the return process as mentioned under Section 10 to claim an exchange of the Product or refund of the amount paid at Refund Policy.
17. TERMINATION
Notwithstanding any of these Terms, we reserve the right, without notice or attendant liability, and in our sole discretion, to terminate your license to use this Site, and to block or prevent future access to and use of this Site for any reason or no reason. Upon termination, these Terms will still apply.
18. WE RESERVE THE RIGHT TO UPDATE AND REVISE THESE TERMS AT ANY TIME
From time to time we review these Terms to ensure that they comply with applicable law. Consequently, we reserve the right to update and revise these Terms at any time. You will know if these Terms have been revised since your last visit to the website by referring to the “Effective Date of Current Policy” date at the top of this page; provided, however, that we will endeavor to provide you with prior notice of any material changes. 19. WAIVER
Our failure to partially or fully exercise any rights or our waiver of any breach of these Terms by the user shall not prevent our subsequent exercise of such right or be deemed a waiver by us of any subsequent breach by you of the same or any other term of these Terms. Our rights and remedies under these Terms and any other applicable agreement between you and us shall be cumulative, and the exercise of any such right or remedy shall not limit our right to exercise any other right or remedy.
20. SEVERABILITY
If any of these Terms is deemed invalid, void, or for any reason unenforceable, that term will be severed and will not affect the validity and enforceability of any remaining term or condition.
21. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the user and Abbaji Interiors concerning this Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written concerning this Site. A printed version of these Terms and any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.
22. MISCELLANEOUS
By using the Site, you agree to receive electronic communications from Abbaji Interiors. You agree that any notice, agreement, disclosure, or other communication that Abbaji Interiors sends you electronically will satisfy any legal communication requirements, including that such communications be in writing. Abbaji Interiors’s failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. Neither the course of conduct of the parties nor trade practice shall act to modify any of these Terms. Abbaji Interiors may assign its rights and duties under this Agreement to any party at any time without notice to you.
23. MARKETING
By consenting to Abbaji Interiors’ SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
